1. Usage Policy

This platform is dedicated to providing quality training in web development and related technologies. Any form of misuse, illegal activity, or unauthorized use of the site or its content is strictly prohibited and may result in legal action.

2. Intellectual Property

All course materials, including videos, code samples, banners, designs, and documents, are the exclusive intellectual property of **Nitish Kumar and Vivaa Pathshala**. Copying, redistributing, or repurposing any content without prior written permission is strictly prohibited and will attract legal consequences.

13. Terms Update Policy

We reserve the right to update or revise these terms and conditions at any point. All updates will be reflected on this page. Continued usage of the site and services implies your acceptance of the updated terms. We recommend reviewing this page periodically for any changes.

14. Privacy & Data Protection

We respect your privacy. All personal information shared by students is kept strictly confidential and used solely for communication, verification, and academic purposes. **We do not sell or share student data with any third parties.** Please refer to our separate Privacy Policy for more detailed information.

19. Force Majeure Clause

In the event of unforeseen circumstances such as natural disasters, technical breakdowns, pandemics, or government-imposed restrictions, Vivaa Pathshala reserves the right to reschedule, modify, or temporarily suspend classes or services. Under such conditions, the institute shall not be held responsible for any resulting delays or disruptions.

3. Course Enrollment

• Submitting the admission form or applying online does not constitute confirmed admission.
• Admission is deemed confirmed only upon successful fee payment, seat availability confirmation, and generation of an official registration number.
• The generation of a registration number is the final step to confirm admission.

4. Fees & Payment Policy

• All course fees are strictly **non-refundable** under any circumstances.
• Fees once submitted cannot be transferred to any other student, course, or future batch.
• In case of delayed or missed payments, access to course materials, dashboards, and classes will be temporarily suspended without prior notice.
• Certificates of completion (if applicable) will be issued only after full fee payment.
• Fee payment is expected in full; however, **EMI (maximum 3 installments)** is available only for courses with fees above ₹3000 and in approved cases only.

5. Lifetime Validity & Rejoining Rights

• Once full payment is completed, students are granted **lifetime access** to the course, valid as long as the course is actively offered by Vivaa Pathshala.
• If a student is unable to continue after paying the fee, they may rejoin the same course in future without any additional charge.
• After course completion, students are also eligible to access any new modules or skills added to the same course **free of cost**.

6. Placement Support

Placement support is available only to students who have successfully completed the entire course. All class assignments and projects must be completed and submitted as per the guidelines to be considered eligible for placement assistance.

7. Course Duration Extension Policy

Course durations are generally fixed; however, in special cases such as slower learning pace or medical emergencies, course duration may be extended upon approval. Documentary proof may be required.

9. Discount & Offer Validity

• Any discount or offer promoted by us is valid only for the same day unless specifically mentioned otherwise.
• Please ensure the authenticity of any discount-related advertisements before proceeding with fee payment or enrollment.

10. Partner & Referral Terms

• Changes in referral or partner programs are applicable only to new enrollments.
• Students already enrolled will continue to enjoy the offer that was active at the time of their admission.
• Vivaa Pathshala reserves the right to modify, suspend, or cancel any such scheme at any time.

11. Student Code of Conduct

Any behavior including but not limited to misbehavior, spamming, abusive language, or disrespect toward staff or fellow students will lead to immediate suspension or permanent termination from the program without any refund.

12. Attendance & Access Control

• Consistent attendance is expected to ensure effective learning.
• Access to live sessions, recordings, and study materials is provided only to registered students.
• Sharing of login credentials, downloading or circulating recordings, or study materials is strictly forbidden and may result in termination of access.

15. Certificate Issuance Policy

• Certificates (if applicable) will only be issued after full fee payment has been completed.
• A minimum of **75% attendance** in live sessions (if applicable) and successful submission of all required assignments or projects is mandatory.
• Possession of a registration number does not automatically entitle a student to a certificate unless all academic requirements are fulfilled.

16. Course Content Updates

We continuously strive to keep our content up-to-date. Modules and lessons may be updated, removed, or enhanced to reflect the latest industry practices. Lifetime-access students are eligible to receive these updates as part of their enrollment.

17. Technical Infrastructure & Responsibility

• Students are responsible for maintaining a stable internet connection and using a functional device (laptop/desktop).
• All required tools or software must be installed prior to the beginning of the course.
• The institute is not responsible for any disruptions caused by technical issues on the student's end.

18. Class Recording & Usage Policy

• Recordings of live classes are provided for revision purposes only.
• Downloading, screen-recording, or circulating these videos is strictly prohibited.
• Access to recordings is time-bound and may be revoked in cases of misuse.

1. Scope of Work

A detailed scope, including features, pages, and functionalities, will be mutually agreed upon before project initiation. Any request outside the defined scope will be treated as a separate task and may incur additional charges.

2. Payment Terms

• Projects under ₹10,000 require **100% advance payment**.
• For higher-value projects: **50% at start, 25% on first demo, 25% before final delivery.**
• Payments are **non-refundable** once a phase is completed and delivered.

3. Timeline & Delays

Project timeline is estimated based on scope. Client delays (e.g., content or approvals) will affect delivery. In case of unforeseen events (technical issues, illness), timelines may be adjusted.

4. Client Responsibilities

• Clients must provide all necessary content (text, images, logo) on time.
• Domain and hosting setup or renewal is the client's responsibility unless agreed otherwise.

5. Revisions & Modifications

• Up to **2 rounds of minor revisions** are included.
• Major changes or new features will be charged extra.
• Revisions must be requested within **7 days** of demo delivery.

6. Delivery & Deployment

• Final files/deployment occurs after complete payment.
• Admin credentials or access will be shared post full settlement.

7. Website Maintenance

• Free maintenance (small text/image updates, bug fixing) for **15 days** post-delivery.
• Annual Maintenance Contract (AMC) available at additional cost.

8. Cancellation & Refunds

• Cancelled projects will **not receive refunds**.
• Any work completed until cancellation will be delivered “as-is.”

9. Intellectual Property

• Client owns rights to website content and design after full payment.
• Core backend/code logic remains developer's IP unless fully transferred via written agreement.

10. Credits & Portfolio Rights

• We may showcase the project in our portfolio unless the client opts out.
• Footer credit (“Developed by VivaaPathshala or www.nitishkumar.info”) is standard unless **white-labeling** is requested (extra charge may apply).
